Terms and Conditions of Use of the MCCABES PLUS Loyalty Program

 (MCCABES PLUS App)

 

 

TERMS AND CONDITIONS

 

MCCABES PHARMACY LIMITED whose registered office in registered office in United Drug House, Magna Drive, Magna Business Park, Citywest, Dublin 24, Ireland, Company Registration Number: 342371(“MCCABES”), PHOENIX PHARMA DIGITAL HUB, S.L. whose registered office in Spain, Barcelona, ul. Carrer Platón, 6 – 08021, Tax Identification Number: B75709493 and PHOENIX PHARMA SE whose registered office in Germany, Meinheim, ul. Pfingstweidstraße 10-12, Tax Identification Number: DE 311 309 783, ("Phoenix", and together with MCCABES "we" or "us") set out below the terms and conditions of use under which customers of MCCABES pharmacies are granted benefits for participation in the MCCABES PLUS loyalty program (hereinafter: “MCCABES PLUS” or the “Loyalty Programme”) which is available in the MCCABES PLUS mobile app ("App").

 

MCCABES PLUS allows members to create a user account in the App and to receive through the App various types of benefits, such as collecting and exchanging loyalty points for products, different types of commercial offers and obtaining other benefits.  

 

MCCABES PLUS is currently only valid for use at the following MCCABES pharmacies:

PARTICIPATION IN THE LOYALTY PROGRAMME

 

This Loyalty Programme is available exclusively through the App, which can be downloaded on a mobile phone via the APP store (Android and IOS).

 

To participate in the Loyalty Programme a member must shop in person in a MCCABES pharmacy in the Republic of Ireland.  The Loyalty Programme does not apply to online purchases.

 

To participate in the Loyalty Programme, you need to be a registered user and be at least 18 years old.  You can only become a registered user by agreeing to these Terms and Conditions of Use during the registration process.

 

 

Only one registered account can be logged in at a time on a single mobile device.

 

 

PURPOSE OF THE LOYALTY PROGRAMME

 

The purpose of this Loyalty Programme is to enhance your customer experience by providing personalized content, offers and services as described below that are tailored as closely as possible to your individual preferences and needs.

 

As a user of this Loyalty Programme you will benefit from a wide range of features and services via the App designed to fit your profile and usage patterns. This includes, but is not limited to:

 

v  User account;

v  Personalized offers of products and services;

v  Offers and discounts that reflect your interests and purchasing behavior;

v  Targeted content in the App and communications relevant to your preferences;

v  Participation in exclusive campaigns, events or promotions in accordance with your profile; and

v  Participation in surveys and customer enquiries.

 

The App is designed to provide you with relevant value as you use it, making your experience more intuitive, efficient, and useful. Where permitted, your personal data will be used to tailor the structure, presentation and timing of communications and offers to suit your use and preferences.  How and why, we process your personal data is described in our Privacy Policy.

 

 

SCANNING THE QR CODE IN PHARMACY

 

In order to get the benefits provided by MCCABES PLUS (collect loyalty points, download a product, take advantage of a special offer, etc.) you must scan your QR code from the App before paying in person at the checkout in the MCCABES pharmacy, otherwise you will not be able to get the benefit for that transaction.

 

 

LOYALTY POINTS

 

Collecting loyalty points

 

Loyalty points are collected for the in-person purchase of eligible products in MCCABES pharmacies. For every 1 EURO spent on eligible products in MCCABES pharmacies, 1 loyalty point is obtained.

 

Loyalty points will not be awarded for any prescription medication or related services which include collection, dispensing, or payment of prescription medication.  

 

Loyalty points are not awarded for products purchased through our online store.

 

Points are not awarded for ineligible products.  MCCABES will at their discretion change the list of ineligible products for which points cannot be received. You can find out more about the list of ineligible products instore at MCCABES pharmacies.

 

At any time in the App, you can check how many loyalty points you have collected.

Use of loyalty points

 

Loyalty points can only be used in-person in MCCABES pharmacies using the coupon process set out below.   Eligible products are identified on the App alongside their stated value in loyalty points.  You can exchange your loyalty points for a coupon to purchase the eligible product in a MCCABES pharmacy.

 

To exchange loyalty points for an eligible product, you need to have at least as many points collected as the value of the eligible product expressed in loyalty points.

 

To exchange loyalty points for an eligible product and to buy the product, you need to:

 

v  select an eligible product in the App and exchange it for your loyalty points;

v  you will see a coupon in the App that specifically refers to the eligible product you have selected;

v  click Yes button and Activate Coupon; and

v  scan the QR code at the MCCABES pharmacy checkout.

 

The amount of loyalty points for the purchase of an eligible product is determined by MCCABES.

 

Loyalty points cannot be exchanged for money or any other benefit unless explicitly stated in these Terms and Conditions of Use.

 

Your loyalty points are reduced when you exchange your loyalty points for a coupon for the eligible product.  Once you make this exchange, it is not possible to cancel the coupon and refund the exchanged loyalty points.

 

The coupon is for a specific eligible product and cannot be used against another eligible product or exchanged for another coupon.

 

The coupon expires on the 15th day after it is exchanged for loyalty points which includes the day the coupon is credited to you. The coupon will expire on the 15th day regardless of whether you activate it or not.  Once the coupon expires, it will no longer be available in the App and can no longer be activated. Upon the expiration of the coupon, you lose the right to download the eligible product you have selected in the MCCABES application. 

 

Example 1: if you exchange your loyalty points for a coupon for an eligible product on day 1 and you activate the coupon on day 14, you must use the activated coupon for the eligible product at a MCCABES pharmacy counter no later than day 15. 

 

Example 2: if you exchange your loyalty points for a coupon for an eligible product on day 1, and you do not activate it; you cannot activate it after day 15.  

 

Expiration of loyalty points

 

Unused loyalty points expire one (1) year from the date they are collected at the checkout in MCCABES pharmacies.

 

Deletion of loyalty points

 

MCCABES will delete collected loyalty points from your account on the App if the eligible products for which the loyalty points were collected are returned by you for any reason or exchanged for eligible products that are not of the same value in loyalty points.

 

Refund of exchanged loyalty points

 

MCCABES may at its sole discretion refund exchanged loyalty points if MCCABES determines that the return of an eligible product is justified and in accordance with MCCABES customer complaints procedure.

 

 

COUPONS

 

Based on your purchase history, you may receive personalized coupons that provide certain benefits within the App.

 

You may receive a coupon that gives a discount on a particular product, or a coupon for buy one product, get another for free; and other such benefits.

 

The coupon will always state the date on which it expires.

 

To redeem the coupon, you need to activate it in the App and then scan the QR code at the checkout of the MCCABES pharmacy.

 

Once you redeem a coupon at the checkout, its availability in the App ceases to exist.

 

 

 

 

MCCABES PLUS OFFERS

 

As a member of the MCCABES PLUS, you can purchase certain eligible products at lower prices compared to non-members. Information about MCCABES offers can be found in the Offers section of the App.

 

The offer always includes the eligible product to which it refers, the full retail price, the member sale price, and the percentage member discount.

 

 

ADDITIONAL DISCOUNTS OF MCCABES PLUS

 

 

MCCABES-Website online purchases

 

You currently cannot use the App for MCCABES-Website online purchases.   For MCCABES-Website online purchases please click on the Online Pharmacies button and you will be redirected to MCCABES-Website (www.mccabespharmacy.com). MCCABES-Website terms of service shall apply (www.mccabespharmacy.com/policies/terms-of-service) when purchasing on MCCABES-Website.

 

MCCABES PLUS Partner discount

 

MCCABES PLUS may enable its members to receive discounts from partners.

 

In such case, the conditions for obtaining partner benefits will be described in more detail in the MCCABES Partners section.

 

We shall not be liable for any products, services, or discounts provided by partners, or any act or omission of the partners, save as required by law.  Please refer to the specific partner website for their respective terms and conditions regarding their discounts, products, or services.

 

 

MCCABES PLUS account

 

 

Currently, access to digital receipts within the App may not be available for all purchases or members. This functionality may be introduced or expanded in future versions of the App. Always keep your hard copy receipt obtained in the MCCABES pharmacy as proof of purchase.

 

 

MISUSE OF MCCABES PLUS

 

MCCABES has the right to take any action it considers appropriate, including restrictions on the use of the App, deletion or suspension of an account and deletion of accrued loyalty points if it has reason to believe that you are misusing the App or the Loyalty Programme.

 

Loyalty points awarded at the time of the transaction or coupons already issued may be removed or cancelled if MCCABES determines that the loyalty points were collected in breach of these Terms and Conditions of use or were awarded in error. For the avoidance of doubt, any advice or actions of our staff that are contrary to these Terms and Conditions of use will not have the effect of changing these Terms and Conditions of Use.

 

The Loyalty Programme is for personal use only; business use is strictly prohibited and constitutes misuse of MCCABES PLUS.  MCCABES the right, at the point of purchase or retrospectively, to determine whether a transaction constitutes business usage.

 

MCCABES PLUS GENERAL PROVISIONS

 

MCCABES reserves the right, at any time and without explanation, to withdraw the App, delete all accrued loyalty points, modify or terminate any discounts or offers provided through the App.

 

MCCABES has the right to change these Terms and Conditions of Use at any time without prior notice to the members.  MCCABES PLUS members Clubcard members who continue to participate in the Loyalty Programme following such a change will be considered to have accepted the updated Terms and Conditions of Use.

 

As a member of the Loyalty Programme, you have the right to delete your account at any time.  Please note that deleting your account will lead to the deletion of all your accrued loyalty points. You will no longer have access to any available discounts and offers.  

 

Withdrawing your consent to the processing of your personal data will lead to the automatic deletion of your account, as without your consent the App cannot function.

 

MCCABES does not give any guarantees that the eligible product will be in stock in every MCCABES pharmacy and advises members to always check first whether the product is in stock to be able to take advantage of a coupon or other offer.  If your chosen MCCABES pharmacy does not have the eligible product, please check its availability at other MCCABES pharmacies.

 

MCCABES reserves all rights to the materials and advertisements related to the App.

 

These Terms and Conditions of Use are correct as of April 2026. They are governed by and construed in accordance with the laws of the Republic of Ireland, and any disputes will be decided by the exclusive jurisdiction of the Irish courts.
